Article 2 โ Acceptance, Eligibility, and Changes to the T&C
2.1 By creating an account on the Platform, you represent and warrant that you are at least 18 (eighteen) years of age, or have reached legal majority under the rules applicable in your domicile, and have full legal capacity to bind yourself to these T&C.
2.2 We reserve the right to amend, add to, remove, or adjust part or all of these T&C from time to time in line with the development of the service, operational needs, and/or applicable laws and regulations.
2.3 Any change will be notified to Users through a notice in the Platform and/or other registered communication channels, and will take effect on the date specified in that notice. Continuing to use the Platform after that effective date constitutes your acceptance of the updated T&C.
Article 3 โ Description of the Service: Rampoeng as a Connecting Platform
3.1 Rampoeng is an application-based technology platform providing electronic means to bring together and connect Users who need help or services for a Job (Posters) with other Users willing and/or able to carry out that Job (Workers).
3.2 RAMPOENG IS NOT A LABOUR SUPPLY COMPANY, AN OUTSOURCING COMPANY, A MANPOWER PLACEMENT AGENCY, A LABOUR BUREAU OR PROVIDER IN ANY FORM, AND IS NOT AN EMPLOYER of Workers within the meaning of the employment laws applicable in Indonesia.
3.3 Rampoeng does not employ, assign, direct, or supervise the performance of a Job by a Worker. No employment relationship, staff relationship, agency, partnership, joint venture, or any form of labour relationship arises between: (a) Us and a Poster; (b) Us and a Worker; or (c) Us and any User, merely as a result of registering for and/or using the Platform.
3.4 The legal relationship arising from a Job โ including but not limited to the agreement on scope of work, Payment, schedule, quality standards, and all legal consequences flowing from it โ is a direct, peer-to-peer legal relationship between the Poster and the Worker concerned. Rampoeng is not a party to that relationship and is not a guarantor of its performance.
3.5 Our role through the Platform is limited to providing technological means, comprising:
Article 4 โ Account Registration and Identity Verification (KYC)
4.1 To use the Platform, a User must register an account by providing data and information that is true, accurate, current, and complete, and must keep that information up to date if it changes.
4.2 User identity verification is carried out in tiers, as follows:
4.3 Users are fully responsible for keeping their account credentials confidential (including passwords and OTP codes) and for all activity carried out through that account. Users must notify Us immediately upon becoming aware of, or having reason to suspect, unauthorised access to their account.
4.4 We reserve the right to refuse a registration, suspend the verification process, or suspend or terminate the account of a User who provides untrue, incomplete, or false information, or who fails the required verification process.
Article 5 โ Job Risk Level Classification
5.1 Each category and type of Job available on the Platform is classified by Us into one of the following Risk Levels, based on Our internal assessment of the potential physical, legal, personal safety, financial, and/or property damage risks relevant to Users:
5.2 Risk Level classification is indicative, based on the information available to Us at the time of assessment, and may be reviewed from time to time. It is NOT a guarantee, representation, warranty, or safety certification from Us that a Job is safe, risk-free, or as described, and it does NOT replace a User's own judgement, consideration, and care.
5.3 Users acknowledge and agree that the decision to post, take on, approve, accept, or carry out a Job โ including a Medium Risk Level Job after a warning has been displayed โ rests entirely with, and is the personal responsibility of, the User concerned.
Article 6 โ User Rights and Obligations
6.1 Every User must:
6.2 In addition to Article 6.1, a Poster must:
6.3 In addition to Article 6.1, a Worker must:
Article 7 โ Posting Jobs and Making Offers
7.1 A Poster may post a Job through the Platform by completing all the information the system requires, including but not limited to the Job name, description, type (physical or non-physical), location or a note that it can be done from anywhere, timing, number of people needed, and estimated Payment.
7.2 A Worker may take on available Jobs through the Platform. Further negotiation on the final Payment, scope of work, and other technical details takes place through the chat feature in the Platform.
7.3 The binding Payment, and the basis on which the transaction is calculated, is the amount recorded by the Poster in the “Agreed Payment” field in the Platform, regardless of the initial amount stated in the Job posting.
7.4 Rampoeng does not, and is not obliged to, verify: (a) the truth and accuracy of a Job description posted by a Poster; (b) the competence, qualifications, history, or good faith of a Worker or a Poster, beyond the Verification/KYC process set out in Article 4; or (c) the final outcome of a Job. The Verification/KYC process is one risk mitigation step and is not a basis for a User to rely entirely on the safety or quality of another User.
Article 8 โ Payment, Commission, Escrow, and the Wallet
8.1 All Payment transactions between a Poster and a Worker for a Job facilitated through the Platform must be made through the mechanism the Platform facilitates in cooperation with the Payment Partner.
8.2 When a Poster accepts an offer and the Payment has been agreed, funds equal to the Agreed Payment are held in escrow through the Payment Partner's system. The Poster may make that payment by deduction from their Wallet Balance or through the payment channels the Payment Partner provides.
8.3 Funds held are released to the Worker once the Poster confirms through the Platform that the Job is complete, or on the basis of the dispute resolution mechanism set out in Article 11. Where a Poster neither confirms nor raises a complaint within the period set by the Platform after a Worker marks a Job as complete, the funds may be released automatically (auto-release) to the Worker in accordance with the Platform's applicable policy.
8.4 We are entitled to charge a commission on every Job transaction successfully completed through the Platform. The commission will be disclosed transparently to Users before they accept an offer or Job. The commission may be tiered according to the transaction value per Worker and/or differ according to the payment method used (it may, for example, be lower for payments made from a Wallet Balance).
8.5 The escrow is operated by and through the systems of the Payment Partner, a payment system provider licensed in accordance with Bank Indonesia regulations. Within this mechanism, We act as the orchestrator instructing when funds are held and when they are released, and We do not control, store, or manage User funds directly.
8.6 Users must read and comply with any additional terms and conditions imposed by the Payment Partner, including but not limited to additional verification requirements for withdrawing funds.
8.7 The Platform provides a Wallet feature supplied and operated by the Payment Partner. A Wallet Balance is not a deposit within the meaning of banking regulations, does not bear interest, and is not guaranteed by any deposit insurance institution. We do not control, store, or manage a User's Balance directly.
8.8 Payments released for Jobs completed by a Worker are credited to that Worker's Wallet Balance. Users may withdraw their Balance to their own bank account in accordance with the mechanisms and requirements applicable at the Payment Partner, including Verification/KYC requirements for withdrawals.
8.9 Users may top up their Balance through the payment channels the Payment Partner provides. Users are fully responsible for the security and use of, and all activity through, their own Wallet and Balance.
8.10 For Jobs requiring more than one Worker, funds are held in escrow and released separately for each Worker, according to each Worker's completion of the Job.
8.11 For Jobs paid at a daily rate, the Payment is calculated as the daily rate multiplied by the agreed number of days, and is released progressively for each working day confirmed as completed. For Jobs carried out at a physical location, the Worker must record attendance (check-in and check-out) each working day through the Platform. A working day with no recorded attendance by the end of the Job period is treated as not carried out, and the Payment for that day is returned to the Poster.
Article 8A โ Referral Programme (“Invite a Friend”)
8A.1 The Platform may run a referral programme in which a User (the “Referrer”) shares their referral code or link with others. A person who registers on the Platform and links that code is a “Referred User”. The programme is single-tier: only the direct Referrer of a Referred User is entitled to Referral Commission, and anyone invited in turn by a Referred User creates no entitlement for the Referrer.
8A.2 A referral code may be linked only once per account, within 7 (seven) days of account registration, and the link is permanent and cannot be changed or transferred. Users may not link their own referral code.
8A.3 “Referral Commission” is a reward for the Referrer equal to a set percentage of the commission or service fee that forms the Platform's revenue under Article 8.4, on Jobs posted by the Referred User that have been completed and whose funds have been released. Referral Commission is separate and distinct from the Platform commission in Article 8.4, and adds no cost to the Referred User or the Worker. The percentage is set by Us, announced through the Platform, and may be changed at any time, with any change applying only to transactions occurring after that change.
8A.4 Referral Commission arises on Referred User transactions occurring within a set eligibility period from the date of the Referred User's registration. That period is set by Us and announced through the Platform. The period in force when the code is linked is binding for that link; a change to the period applies only to code links made after the change.
8A.5 Referral Commission is recorded when a Job is declared complete and its funds are released. Jobs that are cancelled, refunded, or not carried out generate no Referral Commission.
8A.6 A Referral Commission balance may be withdrawn to a verified bank account in the Referrer's own name, subject to a minimum withdrawal amount set and announced through the Platform. For tax compliance, the Referrer must provide their NIK and/or NPWP at the point of withdrawal. Income tax is withheld from Referral Commission payments in accordance with applicable regulations; Referrers without an NPWP are subject to a higher withholding rate under tax rules.
8A.7 A Referrer can see the amount of Referral Commission arising from a Referred User's transactions, but cannot see the content, particulars, or details of the Referred User's Jobs. By linking a referral code, a Referred User understands and agrees that their transactions generate Referral Commission for their Referrer as described above.
8A.8 Users must not abuse the referral programme, including but not limited to creating duplicate accounts, fictitious links or transactions, self-dealing, or any other form of manipulation. In the event of such a breach, We may cancel the Referral Commission (including amounts already recorded), withhold or refuse payment, and/or take the actions set out in Article 18.
8A.9 We may change, suspend, or discontinue the referral programme at any time on notice through the Platform. Referral Commission recorded before discontinuation may still be withdrawn in accordance with the applicable rules.
8A.10 If a Referrer's account is terminated for a breach, the Referral Commission balance is forfeited. If a User deletes their account at their own request, they must first withdraw the Referral Commission balance where it meets the minimum withdrawal amount; a balance below the minimum at the time of account deletion is forfeited.
Article 9 โ Cancelling a Job
9.1 A Poster or a Worker may cancel an agreed Job in accordance with the cancellation policy, which is set out and communicated separately through the Platform and may be updated by Us from time to time.
9.2 We reserve the right to apply consequences for cancellations made unreasonably, repeatedly, or in bad faith, including but not limited to adjustments to reputation scores, warnings, or restricted access to certain features of the Platform, as further set out in the cancellation policy referred to in Article 9.1.
Article 10 โ Ratings and Reviews
10.1 Once a Job has the status of complete, the Poster and the Worker may each give the other a rating, comprising a score and a written review, through the Platform.
10.2 Giving a rating is optional and is separate from the release of escrowed funds, which is based on confirmation that the Job is complete as set out in Article 8.3.
10.3 A rating given by one party is not shown to the other until both parties have completed their rating, or until a period set by the Platform expires, whichever occurs first.
10.4 Users may report a review suspected of breaching the Community Guidelines, for example one containing hate speech, content targeting ethnicity, religion, race, or social group, harassment, another person's personal information, or content unrelated to the Job being rated. We may, but are not obliged to, review and hide or remove reviews that breach the Community Guidelines. This reporting mechanism may not be used solely to remove valid negative reviews that reflect the facts.
10.5 Ratings and reviews are the personal opinion and experience of the User giving them, and do not represent Our views, assessment, or official endorsement.
Article 11 โ Dispute Resolution
11.1 Where a dispute arises between a Poster and a Worker in connection with a Job, a User may raise a complaint through the feature provided in the Platform.
11.2 Dispute resolution through the Platform proceeds in tiers, namely:
11.3 A decision produced by the Platform's dispute resolution mechanism is facilitative, taken in good faith on the basis of the information and evidence available to Us, and is directed solely at determining whether the escrowed funds for the Job concerned are released or refunded. Such a decision is NOT a court judgment, an arbitral award, or a decision binding as a matter of civil law between the parties, and does not prevent or limit a User's right to pursue other legal remedies under applicable law.
11.4 While dispute resolution is in progress, the funds held in escrow for the disputed Job remain held by the Payment Partner until the dispute is concluded at one of the tiers referred to in Article 11.2.
Article 12 โ Prohibited Use of the Platform
In using the Platform, Users must not:
Article 12A โ Community Guidelines, Content Moderation, and Continuous Monitoring
12A.1 We maintain Community Guidelines setting out in more detail the conduct that is permitted and prohibited, including the list of Job categories and content prohibited on the Platform. The Community Guidelines form an inseparable part of these T&C and may be updated from time to time as new patterns of misuse emerge.
12A.2 To protect the safety and integrity of the Platform, We may moderate User Content โ including Job titles, descriptions, and communications through the chat feature โ whether through automated systems (including artificial intelligence) or manual review. We may, but are not obliged to, refuse, delay, hide, or remove User Content and/or Jobs that We consider to breach these T&C, the Community Guidelines, or applicable law.
12A.3 Jobs with certain risk classifications may require review before they can be published (a moderation queue), so not all Jobs go live automatically.
12A.4 We may carry out Continuous Monitoring of activity on the Platform to detect indications of breach, fraud, misuse, or unusual patterns โ including but not limited to detecting duplicate accounts, invalid identities, and surges in activity indicating unlawful mass mobilisation. For this purpose We may use detection technology (including device and behavioural analysis) and/or work with third-party service providers.
12A.5 Users acknowledge and agree that the moderation and Continuous Monitoring described in this Article are best-effort mitigation measures, do not guarantee that every breach will be caught, and do not transfer the personal responsibility of Users set out in Article 13.
Article 13 โ User Safety and Personal Vigilance
13.1 We provide a number of features to help raise Users' security awareness when interacting with other Users through the Platform, including but not limited to: the tiered Verification/KYC system set out in Article 4, the Job Risk Level classification and warnings set out in Article 5, the rating and review system set out in Article 10, the moderation and Continuous Monitoring set out in Article 12A, the Emergency Feature set out in Article 13.5, and the chat history in the Platform, which may be referred to in dispute resolution.
13.2 Without diminishing the measures We take under Article 13.1, Users acknowledge, understand, and agree that:
13.3 WE ARE NOT RESPONSIBLE FOR ANY CRIMINAL OFFENCE AND/OR UNLAWFUL ACT โ INCLUDING BUT NOT LIMITED TO FRAUD, THEFT, VIOLENCE, HARASSMENT, ROBBERY, EXTORTION, OR ANY OTHER OFFENCE โ COMMITTED BY ONE USER AGAINST ANOTHER USER AND/OR A THIRD PARTY, WHETHER OCCURRING BEFORE, DURING, OR AFTER A JOB, EVEN WHERE THE INTERACTION BETWEEN THE PARTIES BEGAN ON OR WAS FACILITATED THROUGH THE PLATFORM.
13.4 Where a User experiences, witnesses, or becomes aware of a criminal offence connected with use of the Platform, that User is urged to report it immediately to the police and/or the competent law enforcement authorities. Users may also report it to Us through the available channels; We will use such reports for internal investigation, suspension of the accounts concerned, and/or cooperation with law enforcement in response to lawful requests and in accordance with applicable law.
13.5 We may provide an Emergency Feature to assist Users in an emergency while a Job is being carried out, for example to share location information or contact a help channel. Users acknowledge and agree that: (a) the Emergency Feature is an aid and is NOT an emergency response service, a security service, or a substitute for the police, law enforcement, or official emergency services; (b) its availability and reliability depend on factors outside Our control, including internet connectivity, devices, and third-party services; and (c) in an emergency threatening life, Users must still contact the police and/or the competent official emergency services.
Article 14 โ Intellectual Property
14.1 All intellectual property rights in the Platform, including but not limited to the name “Rampoeng”, logos, trade marks, interface design (UI/UX), databases, algorithms, and source code, belong to Us and/or Our licensors, and are protected by applicable intellectual property laws.
14.2 By uploading User Content to the Platform, Users grant Us a non-exclusive, sublicensable, royalty-free, worldwide licence to use, display, reproduce, adapt, and distribute that User Content to the extent necessary to operate, provide, and develop the Platform, including but not limited to displaying profile photographs and Job descriptions to other Users, and using User interaction data in aggregated and/or anonymised form to develop and train artificial-intelligence recommendation features on the Platform.
Article 15 โ Privacy and Personal Data
15.1 Our collection, use, storage, sharing with third parties, and processing of Users' personal data is governed by the Rampoeng Privacy Policy, which is drawn up with reference to Law of the Republic of Indonesia Number 27 of 2022 on Personal Data Protection and its implementing regulations.
15.2 The Rampoeng Privacy Policy forms an inseparable part of these T&C. By agreeing to these T&C, Users also agree to the Rampoeng Privacy Policy.
15.3 Users have certain rights over their personal data as set out in the Privacy Policy, including the right to access, correct, port, and delete their personal data, and to withdraw consent given, with the consequences described in the Privacy Policy and/or at the time consent was given.
15.4 For the purpose of verifying attendance at Jobs carried out at a physical location (particularly daily-rate Jobs), We collect the Worker's device location (GPS) data only at the moment the Worker checks in and checks out, with the Worker's consent. That location data is not collected continuously and is used solely to verify the Worker's physical attendance at the Job concerned.
Article 16 โ Limitation of Liability
16.1 TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, SECURITY, OR RELIABILITY.
16.2 As explained in Articles 3 and 13, We are a technology platform provider connecting Users, and are NOT a labour provider, employer, agent, representative, or guarantor of any User. Accordingly, and without limiting Article 13.3, We are not responsible for:
16.3 Where there are mandatory provisions of law that cannot be excluded or limited by these T&C, and We are found liable under those provisions, Our liability arising from or in connection with a User's use of the Platform is limited to the greater of the commission We received from the transaction giving rise to the claim, or Rp500,000 (five hundred thousand Rupiah), unless those mandatory provisions require otherwise.
Article 17 โ Indemnity
17.1 Users agree to release, defend, and indemnify Us, Our affiliates, directors, commissioners, employees, and agents from and against all claims, suits, losses, liabilities, and costs (including reasonable legal fees) arising from or in connection with:
Article 18 โ Suspension and Termination of Accounts
18.1 We reserve the right to suspend or terminate a User's access to the Platform, whether temporarily or permanently, where the User breaches these T&C, the Privacy Policy, and/or the Community Guidelines, breaches applicable law, or where We receive a report and/or reasonable indication of such a breach.
18.2 Users may request deletion of their account through the Platform in accordance with the terms and mechanisms set out in the Privacy Policy.
18.3 Suspension or termination of an account does not extinguish obligations that arose before it, including but not limited to completing Jobs in progress and concluding ongoing dispute resolution.
Article 19 โ Force Majeure
19.1 We are not responsible for delay or failure in performing obligations under these T&C caused by circumstances beyond Our reasonable control, including but not limited to natural disasters, widespread telecommunications and/or internet infrastructure disruption, government policy or action, pandemics, civil unrest, or disruption to the systems of the Payment Partner or other third-party providers used by the Platform.
Article 20 โ Governing Law and Dispute Resolution
20.1 These T&C are made under, governed by, and interpreted in accordance with the laws of the Republic of Indonesia.
20.2 Any dispute arising between a User and Us in connection with these T&C will first be addressed through deliberation with a view to reaching agreement. If agreement is not reached within a reasonable period, the dispute will be resolved through the District Court whose jurisdiction covers Our domicile.
Article 21 โ Miscellaneous
21.1 If any provision of these T&C is declared invalid, unlawful, or unenforceable by a court or competent authority, that provision will be severed from these T&C without affecting the validity and effect of the remaining provisions.
21.2 These T&C, together with the Privacy Policy, the Community Guidelines, and the other policies referred to in them, constitute the entire agreement between a User and Us regarding use of the Platform, and supersede all prior agreements, negotiations, or understandings between a User and Us, whether written or oral, on that subject.
21.3 Any failure or delay by Us in exercising a right or provision under these T&C will not be treated as a waiver of that right or provision.
21.4 For questions, complaints, or requests relating to these T&C, Users may contact Us through the official support channels available in the Platform, or by email at support@rampoeng.com.
